    Kangaroo, I am more than aware that the strata manager works for the OC not me. 

    Yes enough already, the OFT has given me options. Thanks for those who tried to assist.

    Thanks whale, pretty sure that suggestion won’t work. 

     

    I will ring the OFT tomorrow and discuss with them to get some guide on what to do. I seriously don’t know how to be any more clear.

     

    A company with an assigned manager, happens to manage 2 investment properties I own, they stuffed one majorly that the Owners Corporation re-appointed a new manager. So I still have one left with this company with the assigned manager. This property  has some major issues (building maintenance) and I am not getting anywhere with the issues, I believe there is a conflict of interest and I am not being treated fair.

    As for our strata manager which we moved to, I also don’t want to name even though they are fantastic, to much information it’s not going to be hard to guess who I am by some.

    It happens that 2 x invest properties happen to be with the same strata company, with the same strata manager, this strata manager stuffed up big time on one of my investments that we moved to a new company. The problem is he still managers my other investment property, although I spoke to the principle, the principle refuses liability and refuses to remove this clown off my investment. In the mean time we are having all sorts of problems getting a response, getting things fixed, the principle won’t respond either, the EC are being difficult as well. 

     

    Hope theirs has made it clearer.

    I would seek legal advice but I would think as they are tenants they are bound by the bylaws so they can’t cry squatters rights. 

    Squatters are not tenants, so the tenants are in breach of the bylaws (which ones I don’t know as I do not know what bylaws apply), so a notice to comply with the bylaws, if that doesn’t work, then mediation, if that doesn’t work then adjudication.

    TiaMaria I am not sure how to make it any clearer, I showed it to a friend that doesn’t know anything about the situation or strata and they understood it.

    I would agree with you there, but the problem is that people feed native wildlife bread and honey, which causes bird diabetes, sun flower seeds, which is like a drug to a bird that eventual kills, unnatural foods that just ends up killing the birds. So unless you mimic the wild foods of flowers, grubs, native seeds and fruits, more harm is being done that good.

    The SM obviously has something to hide having to rally the EC like that, so wrong and so not ethical.

    Please do not feed the native birds, it is unnatural and can cause all sorts of problems for the birds…. Enjoy the wildlife in the wild…

    Thank you kangaroo, I will not be going anywhere till I have my facts straight, hence sending out my property manager, to do an entire investigation.

     

    Please do not assume the reason why I am not going to any inspection, yes I live in the same State, in fact I live around the corner, but personal circumstances has had me not be able to go anywhere for over a year, I am, just starting to be able to start investigating issues now.

     

    We turning on the switch the fans work, I believe I have stated this over and over again.

    Boronia Thank you, that’s exactly what my electrician stated, he said if it is not sucking but the exhaust fan is working, then there is a blockage somewhere, he then refused to do anymore because it becomes Owners Corporations and didn’t want to void this, his determination was:- 

     

    1. He can see the blades and 

    2. He can hear the blades. 

     

    To me it is common sense, wouldn’t they (the so called experts) have said if they did clean the filters that the problem was the filters, and the fan is now sucking blah blah, but no all they came back with is they have cleaned the blades and around and we recommend you up-grade, blah, and it is impossible to determine if blocked or not.  No mention it is now sucking fine. 

     

    So from this all I can assume is the blockage as my electrician observed is still present, I can not and will not continue paying for an electrician to double check everything.

     

    So in conclusion, this to me is a WARNING that all these trades are extortionist…. In for the buck…. The strata manager should know better, and advise the executive committee what they should be doing in the best interest of everyone… But no I am forced into a stale mate and having to take it to mediation. 

     

    I am no expert, I should be able to rely on the strata manager and the trades to guide me, but instead I am left in the dark place taking stabs and what is what, so so frustrating. 

     

    So that raises a question. Do strata managers get referral commission from trades?
