      Stories like these should be told to illustrate why the reforms proposed by NSW Fair Trading to section 106 of the Strata Schemes Management Act are so badly needed. Section 106 imposes an obligation upon the owners corporation to keep the common property in good repair and to compensate any damage caused. The problem is enforcement – at present only a lot owner can enforce section 106. NSW Far Trading has proposed it be given the power to make repair orders and also to impose penalties. In this case, a well worded order given to the owners corporation by NSW Fair Trading might have seen the water leak stopped and a full mould clean up of the apartment take place to solve the problem, as opposed to the owners taking Tribunal proceedings.
