This website is fantastic, informative, and I wish I had  seen it sooner. Ok . Here goes.

If  a strata plan has not identified balconies as common property  and the owners corporation is demanding those without balconies pay extradoniary fees ( not for OHS resons) but to increase the resale price of indivual apartements ( with balconies)  in there any legal recourse in this matter?

NSW strata law is unclear on this one…  only to say that repairs for OHS a neccesary, must be like for like  ( similar price to orginal balconies)

      any advice?

PLEASE ... If your property is not in NSW, mention its location (state). Don't identify companies or individuals by name. Don't mention or promote your company or services. Keep acronyms and initials to a minimum. Please, don’t use “quote” unless there is a specific point to which you wish to refer, then highlight (define) that specific passage before you click on "quote". Otherwise just use reply. THANKS.
