      Good Afternoon All,

      Our Strata’s townhouses (4 in Inner West Sydney Area) have 2 windows per townhouse that are on the first floor.

      We have been charged $110.00 dollars for the NSW Child Window Safety Compliance Check (20/11/2014) by our Strata Manager. It was basically completing a form and emailing it to the Strata Manager.

      Shortly after our last AGM we received a quote for fitting child window safety locks to the windows in each townhouse. As I have become quite suspicious of anything sent to us by the Strata Manager I decided to review the Strata Schemes Management Amendment (Child Window Safety Devices) Regulation 2013.

      Our windows, hopper style, have complying window safety devices. Clause 31 (3) (a) ” is capable of restricting the opening of a window so that a sphere having a diameter of 125 mm or more cannot pass through the window opening”.

      I have advised the strata manager of this and was advised that I should supply the compliance certificate for the window locks as a copy must be retained by the strata manager’s office. 

      My questions are

      1. Is this correct?
      2. If correct, where would I get the compliance certificate?
      3. Is there a cost for this and who should pay – would/should the $110.00 paid by the strata plan pay for this?
      4. When are the Child Window Safety Devices regulations effective?

      Any assistance would be greatly appreciated. As I’m sure most will pick up on, I am not happy with strata manager.
