      Hi, I was wondering if someone could offer me a bit advice as to what I can do.

      I live in a block of units with a chairman who runs the place as if we were tenants from 3rd world countries. The worst bit is everyone is so afraid of him. Behind his back people would agree with what I say and think he is a bit of a bully, but as soon as we go into a meeting, they become quiet or agreeable to any of his stupid ideas in his presence (e.g. a paint job worth tens of thousands of dollars with only one quote to proceed).

      When I give the EC advice to comply with relevant laws to cover ourselves, he argues with me on everything. Thathe knows nothing about any laws make no difference at all. His attitude is if he thinks that the particular law is stupid, then it wouldn’t apply to us.

      I recently had a run-in with him as he kept his personal properties and car on the common property which became an impediment for my next neighbour and I to garage our cars. We put in a joint request to the EC of which I am a member. He accused me of fabricating the story in front of all other EC members. It turned out, he got half-drunk and blocked my neighbour’s way that afternoon. She got so scared and probably agreed to pull out the request. He made me look as dishonest as any politicians.

      Smoke from his cigars and cigarettes pervade the my toddler son’s bedroom and our living room. I have confronted him a number of times, but he just ignored us and asked how could his ciggie and cigar smell bad.

      He likes to play really loud music on Saturday mornings just before 7am. He does stop if I tell him so, but the idea of staying in a warm bed on Sat morning is no longer there.

      Any advice is really appreciated.

      Given that you are on the EC, the fact that he is an office- bearer affords him no greater rights than you or the other members of the committee.
      Some options to consider:
      1)Issue a notice to comply regarding noise and common property.
      2)Take him to the CTTT (you personally or the OC)
      3)Get the numbers together and vote him off the EC
      4)Repeat steps 1-2 as necessary (and it sounds like it will need repeating with this chap) until you get satisfaction

        MattB’s advice is right on the money.  But the first thing you need to do, as he says, is make sure you have the numbers.  You can’t be the only person who’s embarrassed and appalled by this person so check that you have the support and have a motion added to the agenda of the next EC meeting to vacate the Chair and elect a new chairperson.  You would only do this, of course, if you knew who was going to fill the role and who was going to support the move.

        By the way, it doesn’t matter how many owners and their proxy votes who got the Chairman elected, it’s one member, one vote on the EC and all it takes is a simple majority to remove the Chir form their office (but not from the committee).

          think I will just do that. The last couple of years,  I have, on a number of occasions, warned him that I would take him to CTTT and I would apply for a noise abatement order from the court. He pretty much ignored or disregarded what I said. His confusion of my nicety for ineptitude really necessitate a visit to CTTT now.
