We recently had our annual fire safety check and the inspector altered the front door to our flat stating that it didn't close properly. Unfortunately he removed the restraint on the hydraulic arm attached to the door which stops it from slamming. On leaving the flat the next morning, instead of slowing down as per usual, the door slammed on my middle finger ripping off the tip which could not be replaced. I have some out of pocket expenses and on going physio and was wondering who I approach for compensation and how this is done

On the strata side I'd check whether any alterations to common property following a fire order were authorized by special resolution at a general meeting.  Legal requirement or not this is the only means of approving changes and it may be that in going through the formal excercise that valid objections could be made or a more careful choice of door closers.  If not properly authorized perhaps you could sue the Owners corp.

Hi Dech. Thanks for that. Work was approved – l’m an owner on the executive so it seems ironic to in effect sue myself! I was wondering if l do this then the next step would be for the owners corporation via the Strata managers to sue the fire safety company in order to recoup any losses?
