Searched forum, but did find same topic as this one

Owner X has decided to park a private box trailer on common property without OC approval. The common property is located at the rear of our parking lot, which means each time owner X wants to use trailer (exit or return), we have to move our car to enable this.

Problem as we see it:

Storing private property on common property is non-compliant with a by-law. In this case, one owner X benefits by having a location to store a private trailer, to the disadvantage of myself & partner (ie. we would have to move our car each time owner X wants to move trailer).

Each owner in our unit block has one car park space, which they pay levies for. Owner X effectively wants an extra parking space without paying any additional fees.

Solution?

Can we refuse access for trailer movements through our parking lot? ie. owner X does not have ‘right of way’ through our parking lot.

Please advise what action can be taken if owner X refuses to remove trailer from common property, or any other recommendations you can make.

ps. Have spoken with owner X on above issue. Their view is that the common property space is not being used by anyone else, so why can’t they use it. I advised them to talk to our Strata manager to discuss their request.

Most strata schemes have by-laws forbidding owners from parking or leaving goods on common property. Check your by-laws and see what it says there then ask your EC or strata manager to take action.
