Tree on neighbouring property

      We live in a Strata development. Our strata neighbour has a coastal banksia tree whose trunk is in her yard but the bulk of the tree overhangs our yard. The trunk of the tree is within millimetres of damaging our roof and our landscaper says the roots of the tree could be undermining our foundations. Our local council suggested we ask the Owners Corp to lodge an application for removal of the tree. The Owners Corp says trees in neighbouring yards are the responsibility of individual owners. The owner says she can't afford to a. lodge an application with Council or b. pay to have the tree removed. Does the Owners Corp have any responsibility in this case? What happens if the tree does start to damage our roof?

    PLEASE ... If your property is not in NSW, mention its location (state). Don't identify companies or individuals by name. Don't mention or promote your company or services. Keep acronyms and initials to a minimum.
