QUESTION: If my windows are being replaced in my unit by the body corporate and I can’t live there during this work being done what are the rules about reimbursement of rent? If I am not in the unit for a whole month, for example, surely I don’t have to pay rent for that month? Thanks – Ebuffie (via Flat Chat Forum).
ANSWER: If you can’t live in the apartment because of building work or renovations, then you are entitled to some compensation, even if it’s just a rent “holiday”.
Your landlord should have insurance that covers such eventualities but if they don’t, it’s not your problem. You can’t be expected to pay for something you don’t get. Log on to tenants.org.au for specific advice.
However, one correspondent to the Forum saw things a little differently.
“If this is being done by a reputable company your apartment will be completely habitable,” says Mr Strata.
“There should be no reason to seek a reimbursement on rent, though if you are considering this approach, be ready for a rental increase as soon as the project is complete!”
