The building was built in the 1960’s and is very no frills.
An owner took the OC to NCAT and lost. In the budget there an amount budgeted for $20,000 for legal costs refunded. This money did not go into the Admin fund and hence the deficit. However $50,000 went into the CWF where they had only budgeted for $30,000. Is is possible to move the $20,000 to the Admin Fund? I have asked the Strata Manager about this but he has not replied.
It would be good to sort this out now and not have the amount sliding round for years!

It is a Body Corporate Elite Declaration for Management Committee Liability.
We are not able to get terms and conditions until it is signed. There have been a few high water damages claims and most insurers are not interested. Apparently insurers can sometimes ask for these.

There is only one owner of the lot, hence my saying the spouse of the owner.
From what you have said there is no circumstance when someone should absent themselves from the vote. In another EC that I am on a member left the meeting while we discussed whether to pay for repairs and on another occasion a member was left out of email discussions regarding a demand notice from their insurer. That is why I asked whether it was just “good manners”.

A little confused but you are all helping me to get a better grasp on what outcome I would like to see. I am not anti garden, in fact the block has extensive well maintained gardens.
As to the Strata Manager, they appear to have been less forceful than I would have liked and quite happy with an informal approach to the running of the OC. It is basically a harmonious block but I would like a bit more structure as the current one has the potential for owners to do their own thing. Allowing the window in the side wall to be replaced with a door has meant that they now would like to create a garden. A next step could be a paved area etc etc and really only to benefit one owner. I guess if I took my blanket and had a picnic outside their side door they would be highly unimpressed!

You have certainly given me lots of things to consider and shown me an ordered way to approach this issue. I think I prefer the bureaucratic approach as major works have been done in the past by owners, with permission, but not by special resolution or bylaws. After 20 years there are only a few of us who remember what happened or why and new owners make assumptions that are incorrect. I could certainly see that happening in this case if we did not make a special by-law.
The owners are new to strata and I feel struggling to understand after selling their family home and being able to do what they liked there. They are involved with the EC but only raised this after the AGM notice had been sent and so it appeared in an ammended notice. In their request they do make the comment that both gardens would only benefit their unit.
Thank you. It is very frustrating as it was a 10 year maintenance contract and it would appear to have rolled over for another 10 years! I would have thought that maybe the SM or Building Manager would have flagged this for us.

I have become involved this year but not as Treasurer. Even if I am not the Treasurer am I able to request a copy of the detailed expenses?
I was also interested to read the comment “The big issue I see is the payment of repair invoices out of the admin fund… Which if you look at the strictest interpretation of the act, is not how it was intended…” Am I correct in assuming that if we have some large unexpected repair bills we could have the money come out of the sinking fund? That would at least stop the admin fund from going into the red even more. Our sinking fund looks quite healthy.
