Can a Strata Manager actually call a General Meeting? Particularly after the Strata Committee had already approved the go ahead for the flooring to be done.
We have a Bylaw re appropriate sound proofing and evidence from the lot owner demonstrating that they have appropriate sound proofing.
Is our Strata Manager overreaching their duties?
Thanks for your responses. We had a majority supporting the work to be done. I got two quotes, one much cheaper than the other. So, I’d like to go ahead with that quote. Do I need approval again from the SC to commence works?
It’s hard to be happy when a Strata Manager breaks the SSMA rules. Are they doing it because they’ve been persuaded to by an owner (as happened recently in my case) or do they not know or care less about the rules.
The issue of double glazing is now on a general meeting’s agenda. But the motion states it requires a special resolution to pass.
How do I object to this at the GM?
I think you can only elect SC members at an AGM. Not a general meeting. And owners can’t just nominate someone to be on the SC. They have to nominate themselves.

The council has emailed the following: If the lot “is being used for an industrial use, an appropriate approval would be required. This approval may be an issued by a private certifier not Council.”
Good point Sir Humphrey re the loading dock. They are, in fact, one and the same.
However, this guy, who works in the building, has been parking there for years now. He had to walk up the stairs to get to the “loading dock”. If he were concerned about falling down the stairs, he should have parked in his allocated space and used the lift!

Meanwhile the new owner still hasn’t answered whether they have been to council and still thinks they can do anything they like regardless of whether it’s common property or not.
Legal advice says if the unit block is zoned “light industry” we can’t stop them moving in with embroidery machines. He said we could stop the DA though. What DA? And can we stop it?

In the meantime, I rang council and a member of staff said if the new owner is changing the use of the Lot, they will need “consent”. Unfortunately, they did know from whom?
So I rang Planning and Environment and they said the new owner will need to put in a Development Application.
Thanks TrulEconcerned. I’m on the Strata Committee and have been arguing for a new By-Law for years. So I did write one and hope to have it passed at a General Meeting. Your suggestions are excellent, thank you.

Find a new strata manager? Impossible! I’ve never met anyone who has recommended a strata manager. Be that their past or present one or by word of mouth. Ideally, SMs should be rated with a star system made available on a respectable website.

I’m definitely excluding electricians, plumbers etc. These guys, and two in particular, enter the building with remote keys (how did they get them) and alternate between parking in the dedicated commercial space and the visitor spaces. I know this because I have taken photos of them, which I have supplied to the SC, and watched them on CCTV.
A Newsletter issued by the Strata Manager to all owners stating that these particular cars (and other offenders) will be issued a Notice to Comply if they continue to breach our Bylaw was regarded as not legally enforceable? Eh?
By the way, Jimmy, that quote you gave from Lookupstrata was in answer to the same question I’m asking here written to me some years ago. And I used it this week to explain to everyone what is meant by “visitor”.
