      Hi guys,

      Wasn’t sure which sub-forum to ask this question.

      I was wondering where the strata management gets the owners’ names that they list on and address with official correspondence? Is it some kind of land title database or something?

      I was wanting to know whether I could ask the Strata management to add my name to my mother’s name (she’s listed as owner) to make things easier when it comes to corresponding with strata management? An authority to speak on my mother’s behalf has been submitted in the past but it seems that with every new strata manager, they question my authority to speak about strata matters because my name isn’t listed with the Owner, for example, how a couple would have both their names listed.  I noticed that one of the couples who is no longer a couple removed one of the names, so did they just call up strata management and ask for the removal of a name? If it’s that easy, then i should be able to just as simply add a name. My mother obviously approves of this.

      Not sure if i’m making sense.

        The contents of the strata roll are obtained by the secretary by the new owner submitting a notice on transfer of title.

        The act says the roll contains the owners name (that includes multiple names if there are two or more owners), address (for services of notices) and any appointed agent.

        However an agent can only be appointed by a corporation (who is the owner) or if the owner is a person and has some incapacity or  does not read English. It does not seem your mother is incapacitated. If she cant read english, then there may be grounds to include you as an agent.

        But all notices will then go to  you. The act does not permit sending notices to multiple addresses.

        It also means that the agent is the only one  able to vote.

          Surely the answer is to get the mother to ask the secretary/strata manager to change the address for services of  notices. Many investor owners use their rental agents’ addresses in this way.

            It’s not that I need the strata notices to be sent to my address as I already have access to them but more that i would like my name included with hers as Owner. You see the names of the owners listed in AGM’s, extraordinary meetings when it comes to attendance, levies, etc.

            When I say correspond with strata, I just mean speaking with them, emailing them, etc…

              Noting that the original question was asking “...where the strata management gets the owners’ names...” here’s something people may not be aware of.

              I am the Secretary of a small OC in Victoria and when a unit was sold recently I received a document from Pexa which contained the following details:

              Name of seller, their new address, their phone number and email address, and the name and details of their lawyer

              Name of buyer(s) their previous address, their phone number(s) and email address(es), date(s) of birth, and the  name and details of their lawyer.

              And being a document received as part of the Owner’s Corporation normal business it is discoverable by anybody who has legal access to our files.

                The thing is, you’re not an owner, so you can’t be included on the roll . Perhaps you could look at an enduring power of attorney.

                  Even if he has an enduring power of attorney, that can be overlooked when the strata manager changes. All it does is give him permission to act on behalf of the owner. It doesn’t mean his name gets added to the list of owners to receive notices. He’s reliant on the strata manager to remember that he has EPO, or, in the case of a new strata manager,to check their records without being asked to (which let’s face it, isn’t going to happen).

                    As everyone else said, you cannot be listed as an owner because you are NOT an owner.

                    However, the owner can appoint you as their proxy for a defined period of time.  Look up Strata Schemes Management Act 2015 Schedule 1, Part 4, Division 2  Section 26 “Appointment of proxies”

                    When you are a proxy, your name will appear on the minutes of the annual general meeting, extraordinary general meeting etc.  It will not appear on any financial reports.
