Hi there
Somewhat seeking building advice here or just seeing if anybody has been in a similar situation. Our new 5 storey building has some noticeable water ingress after heavy rain in the basement/underground garage. Please see photos here.
We are not sure if this is considered defective work as under the BCA, the basement garage is Class 7 building and is not required to be provided with measure to prevent moisture entering that part of the Building. (advice provided by VBA quoting BCA)
One though could argue, it is affecting the use of storage cages and whether long term structural integrity could be compromised.
I am on the SC so I am in a bit of dilemma of how much of a case we have.
Have started getting prelim advice legally.

I’ve seen similar photos. Your issue is actually quite common.
It’s best to get a professional assessment.
But I do know that walls in basement car parks can actually be structurally designed to weep after rain. The water should however get drained away. And if it is affecting storage or causing a nuisance, the OC should be looking to get the problem remedied.
Get the professional assessment anyway. Because even if it turns out to be built to code, the questions from owners will still keep coming.

If the new building warranty period has expired. I suggest contact you strata insurer to evaluate the situation. Act on there advise, as it would be became a costly process to prevent the water entry to the under cover car park area. Going it alone would require a structure engineering report with regards to the problem.
