Hi there
Somewhat seeking building advice here or just seeing if anybody has been in a similar situation. Our new 5 storey building has some noticeable water ingress after heavy rain in the basement/underground garage. Please see photos here.
We are not sure if this is considered defective work as under the BCA, the basement garage is Class 7 building and is not required to be provided with measure to prevent moisture entering that part of the Building. (advice provided by VBA quoting BCA)
One though could argue, it is affecting the use of storage cages and whether long term structural integrity could be compromised.
I am on the SC so I am in a bit of dilemma of how much of a case we have.
Have started getting prelim advice legally.
