I don’t know if this is where I can ask a question or just comment on a particular article.
My daughter owner occupies her unit in a block of 8. The renters in the unit above her have a mate living in their garage. It is immediately below our daughter’s apartment. The garage door is being operated multiple times a day and his cigarette smoke permeates her bedroom. She has informed the agent but nothing has happened in 3 weeks.
What is the legal position of someone living in a garage?

GP – It is illegal to live in a strata garage. You may have missed it but a response to your question was posted 4 days ago. Click on the link below:

I wonder why the agent refuses or have not done anything after 3 weeks. Since it is indeed an illegal act to do, you could try asking your daughter to speak to the agent again and bring up the issue of illegal staying. The agent could be in cahoots for all we know. Bringing up the issue of illegal staying could push the agent to do something about the issue.

It’s illegal – a garage is not a habitable space.

Save time and effort and call the Council.

PLEASE ... If your property is not in NSW, mention its location (state). Don't identify companies or individuals by name. Don't mention or promote your company or services. Keep acronyms and initials to a minimum. Please, don’t use “quote” unless there is a specific point to which you wish to refer, then highlight (define) that specific passage before you click on "quote". Otherwise just use reply. THANKS.
