      Hi All

       

      Quick question. There is a proposal on the table for our block of units (in NSW) to sell off some unused roof space to a developer to pay for much needed building repairs. Without getting into planning issues etc, does anyone know what type of resolution is required to achieve this. Is a unanimous (100% agreed) vote required to do it or a special resolution (75% agreed). I know that the new laws require only 75% to sell off an entire building but not sure they apply to selling off part of a building.

        This requires a special resolution, refer section 33, Strata Schemes Development Act.
