      Our fence has fallen down. We have requested it to be replaced in the last AGM and the vote is no. It has now fallen down and the BC managers have asked for a safety report. I have searched online but cannot find any in Brisbane. The BC managers never reply to us as I have asked who do I call to get a safety report. Anyone know who does safety reports on a fallen down fence.

        So which fence has fallen down? It sounds like the manager is stalling until you go away.

         

        If it is common property they need to fix it and do any preliminary work such as a safety report if required.

          They have an obligation to address this in a timely fashion – for building maintanence, or WHS, which according to industry best practice (ABMA Buidling Mangement Code. is from 1 day for urgent to 30 days for worth doing. You might like to quote the BCCM Act (2008) relevant chapter (find it online) and mention their duty to act or, as you are free to do, seek intervention and adjudication from the Qld Office for the Body Corporate Commisioner, but call their office for some free advice before on how to get your ducks in a row first.
