    Hi

    After some thoughts..

We have parking spaces that are common property with an exclusive use by-law for each unit. Our building is inside the parking levy zone and I did see the earlier post on this where the owners corporation was paying for the levy.

In our situation, a unit owner is separately renting out the parking place of which they have exclusive use to a non-resident – it is pretty clear that the levy applies.

However, the legislation specifically mentions that the owners corporation would be the owner and responsible for the levy. We have no by-law that limits parking to residents which would meet the exemption criteria in the legislation.

Has anyone dealt with this type of situation?

PLEASE ... If your property is not in NSW, mention its location (state). Don't identify companies or individuals by name. Don't mention or promote your company or services. Keep acronyms and initials to a minimum. Please, don’t use “quote” unless there is a specific point to which you wish to refer, then highlight (define) that specific passage before you click on "quote". Otherwise just use reply. THANKS.
