      The carpet in the stairwell is 20 years old and is worn through in places thereby creating a hazard. There are only 2 levels of stairs.  I have raised this problem and I have been told by a neighbour and strata that due to other issues in the building requiring funds they do not wish to replace the carpet.  How can I get some action on this as it is extremely shabby?  We have a Strata meeting next week.

        Hi, Have you looked at the disposable funds available in the annual accounts; if no funds available would a temporary levy be a solution on the grounds of safety? 

        Depending on when the building was constructed, perhaps look at materials under the carpet, and possibly less costly than carpet replacement, would a solution be polishing, if concrete, varnishing, if timber, or leaving floor exposed if terrazzo or similar?

          The OC have an absolute desponsibility to maintain  ommon property, including the carpets. Speak to the SM anx ask them whatbthey will do to replace the carpets and advize him that if nothing is planned to be done in a reasonable time, you will go to NCAT to seek orders for the carpet to be replace.

          See what happens then

            Hi, Thanks your reply.  There are plenty of funds available – they just don’t want to spend it!

              Often owner’s committee’s are not away that by law they are required to ensure the property is kept in good condition and structurally sound. That’s regardless of funds you have, workload if other stuff is underway, time available is short, how much effort they do or dont put in, individual taste, whatever: if it needs to be done, it needs to be done, and ideally done before then.

              If it’s not done it harms resale values and amenity and if it causes an accident you may actually void your insurance because the place wasn’t maintained as your insurance requires. Find it written in your State’s Act and show them that so it isn’t you but the State saying as much. And if it gets the go ahead be sure that the people who thought it was all fine are not the ones to reorder the carpet as you can bet it will be a horrible price or colour or both, and you’ll likely be then stuck with it.

                Have you tried reasoning with neighbours on the grounds of safety, ohs etc..may be more effective and neighbourly than legal action..
