A unit has been left empty for many years and no one inspecting on any regular basis. Leakage into unit below resulted in access where evidence of water ingress and magnasite removal was necessary and finding concrete cancer near balcony doors. Does the Owners Corporation have any right to claim the cost of repairs to the slab from the owner?

Obviously, the neglect of the apartment has probably contributed to the failure to discover and remediate the concrete cancer, but proving it may be another matter entirely.

That would be your first challenge, getting two or three independent assessments that neglect caused or exacerbated the problem and at what cost. After that, you might speak to a strata lawyer.

PLEASE ... If your property is not in NSW, mention its location (state). Don't identify companies or individuals by name. Don't mention or promote your company or services. Keep acronyms and initials to a minimum.
