      Hi All,

      I am expected to pay a special levy which I do not believe I should be paying for very unique and exceptional reasons.

      Does NCAT have the ability to make a particular lot owner exempt from a levy? And/or how would you run such an issue through NCAT to achieve the same (i.e. what sections of the Strata Management Act)?

      It would be ideal if I could run my claim via section 106(5) of the Strata Management Act, however, it is my understanding that NCAT can not actually award compensation.

        Section 87 of the Act deals with variations of levies payments. Section 88 requires the Owners Corporation to refund the money paid in levies where they have been found to have been unjustified under Section 87.
