I’m and owner occupier and on the Executive Committee of a block of 15 units, there is another guy and a woman who are also on the Executive Committee.

The husband of the woman on the EC has taken it upon himself to do the gardening.  Three years ago I got an email saying that they like gardening and would now be doing some planting etc, no problem.  Over the last 18 months however he has started poisoning large trees including a 40 year old gum which ended up having to be removed, two other well established trees have be drilled and poisoned, he’s sawn off a vine around the bin area which was just left to die and also poisons grass.  It is him; he keeps the poison at the door of his garage.

At our most recent AGM I asked that a large bush be kept (after we approved mulching), just this week the bush has started drooping – obviously he has poisoned it.  I’m furious as not only did I request that it stay there (we are on a roundabout and it offers privacy), he did not advise me that he would do this – the bush is outside my bedroom window but a good 40 feet from his balcony.  He has deliberately disregarded me despite the bush being brought up at our AGM. 

My husband had a run in with him three years ago and since then they do not communicate with us at all and things are done without us being advised.  The other guy is friends with this bloke so no help to us.

What are our rights with this ?  I want all the poisoning to stop and fear he could start on more trees.
