      We are a 30 year old 10 unit class B complex in Canberra with a bank of mailboxs, a driveway, 2 lights, and some common pipework. The cost for maintaining these items is included in our 15 year “Sinking Fund Forecast”.

      Do we need an additional “Maintenance Schedule” as described in section 24 of the ACT UTMA? Our SM just paid  $315 for it (despite us passing a motion in 2024 that we did not require a professionally prepared Maintenance Schedule). It may be a very expensive 1 page document when we get it!

      We don’t have any of the things required in the regulations, other than external brick walls (OC responsibility) and a tiled roof (owner responsibility). Can we prepare our own Maintenance Plan with “Not Applicable” against 95% of the items?

      Below is the relevant section of section 24 of the Unit Titles (Management) Act 2011
      (2) For meeting its obligations under subsection (1), the owners corporation must prepare a maintenance plan taking into account the developer’s maintenance schedule (if any).
      (3) The maintenance plan must contain the matters prescribed by regulation.
      And below is the relevant section of the Unit Titles (Management) Regulation 2011 that outlines the requirements of a maintenance plan.  We don’t have any of these things, other than external brick walls (OC responsibility) and a tiled roof (owner responsibility)
      Maintenance plan—Act, s 24 (3)
      A maintenance plan must include the following:
      (a) a plan for the maintenance and inspection of systems, equipment, structures and other things on the common property if the maintenance and inspection is reasonably required to avoid future damage to, or failure of, the thing including(if present) the following:
      (i) exterior walls, guttering, downpipes and roof;
      (ii) pools and surrounds, pool fencing and gates;
      (iii) air conditioning, heating and ventilation systems;
      (iv) lifts;
      (v) fire protection equipment including sprinkler systems, fire alarms and smoke detectors;
      (vi) security access systems;
      (vii) electric vehicle charging stations and associated infrastructure;
      (viii) embedded networks and micro-grids;
      (vix) solar panels and associated equipment and any other sustainability infrastructure;

      (b) as provided by the developer or as reasonably available—
      (i) the warranties for systems, equipment or other things mentioned in the plan; and
      (ii) any manuals or statement of maintenance requirements provided by the manufacturer of the system, equipment or other things mentioned in the plan; and
      (iii) the name and contact details of the manufacturer and installer of the system, equipment or other things mentioned in the plan.
