Back in 2024, one of our many blocked drain pipes caused flooding in an apartment below. In addition, the membrane on the roof above that apartment needs repairing.
The owners of the apartment had to file an application with NCAT to have the common property repaired and now a new strata committee wants to hire lawyers to attend on the owners behalf.
Who should pay for the lawyers fees and why? The building where the flooding occurred is one of two separate buildings in our complex.

The other owners should be informed that if they committee hires lawyers and loses, then only the failed defence owners – i.e. the majority – will have to pay the legal fees. The bill will have to be covered by a special levy and the winning plaintiffs can’t be included in that.
