I recently move to an apartment in Melbourne, Victoria, which build around Year 2000, where I found each time raining, all the water from the balcony of the upper unit trend/cascade to my balcony throw two gap of their glass fence. The deisgn of the building balcony that I have open area that I can see through the top but there is two enclosed fence of upper balcony on top of my open top. I asked the OC manager to have a look if that is a problem of blockage of the upper balcony draining pipe and if he can help me to alert the upper unit. OC manager came to my balcony and had a look face to face reply to me is that it was the original design of the building that some apartment unit’s balcony without properly standalone exhaust of water point drain to outside facade or draining pipe but collective to some other unit’s balcony (which is like mine one) and then exhaust to outside, I wasn’t ‘buy’ this theory, and he seemed not want to give any solution, just said this was the way as it is, and disclaimed OC office has any responsibility or action to be taken as the balcony is your property and it is between two units problem. He said it is common in Australian and you just need to clean the exhaust hole/point drain. But today, just a 15 minute rain, and I saw a small water falls pouring to my balcony from the upper unit and that my little shallow point drain is not fast enough to exhaust the water outside. I don’t know if I have to have purchase multiple buckets to collect water drain from upper balcony for each raining day.
What are suggest solutions that I may have or action I can take to? to OC and to upper unit owner?
Is that correct that this is common problem of design of the builder in Victoria/Australia that unit owner have to suffer without any solution?
What expertise I should hire to get a check or report if require? pumper? or hire a lawyer?
I am very upset to have this found out for my first home.
