Slim pickings on the Forum front this week – something to do with the kids being back at school, I imagine – but one Flatchatter wanted to know who was responsible for the original waterproofing in his bathroom.
Now, this wasn’t the usual case of badly installed membrane under the bathroom tiles (the most common defect in all new apartment blocks).
No, this was a leak into the next room because the area around the mixer tap had never been properly sealed.
Now, our Flatchatter is concerned because internal walls are supposed to be the lot owner’s responsibility. Maybe so but waterproofing is largely the owners corp’s.
The apartment is eight years old so the defects claims have long gone. The “who’s responsible” memo says that owners are responsible for leaky taps and leaking walls could be one or the other or both.
It’s not just fixing the leak, that’s easy. Who pays for the damage to the tenant’s clothes from damp and mould. You’ll find my non-legal solution HERE.
