So let’s go again with another hot topic from our Lawyer in the Hot Seat webinar. The question was, what constitutes a “failure to act” under NSW strata law?
More to the point, what would be a serious enough failure to justify removal of a committee and replacement with a compulsorily appointed strata manager under section 238.
