UPDATE (July 2025): In NSW changes to common property that involve sustainability measures can be approved by a special by-law requiring only a 51 per cent majority. These would include installation of reverse cycle air-conditioning, double-glazed windows, EV charging and solar panels. Also, applications for common property by-laws that involve sustainability measures can’t be refused on the grounds that they would change the appearance of the building.

So true. Strata can be a treacherous minefield. A trusted, informed voice of reason has immense value.

There seems to be a general principal in strata that a decision made at a certain level can only be rescinded at that or a higher level. Therefore a decision made at an general meeting would have to be rescinded at a general meeting for it to require reconsideration. I say that with my bush lawyer hat on so it’s just my opinion, not 100 per cent reliable advice.

I am closing this thread because none of the above should be here. Someone jumped on the automatic posting of the Forum Roundup befoere I got round to deleting it and responded to three different question in the one place. Clever, huh? Take the words “installing double or triple glazed windows” for instance. Does that only include the glass or the glass AND the frame?
I don’t think you can separate the glass from the frame in double glazing. The government has moved the definitions of sustainability renovations from the sustainability clause to just making them minor renovations under section 28 of the Regs.
Your problem may be that you are referring to doors wheras the Act refers to windows.
Double-glazing is a sustainability issue becaus it reduces the need to artificially heat or cool.

Subsidising unpaid levies – maybe … a loan against the property?
We’re talking about people who are struggling to meet their current financial commitments. Another high interest loan probably isn’t going to help much.

I don’t understand – so if, for example, the Accounting fees are $100 and there are 10 units- each owner gets a bill for $10.
I think you may be confusing units of charge with residential units (i.e. lots). There are different costs per chargable fees.

Is that plausible?
Not really. Exchanges as part of running an apartment block carry considerable “qualified privilege” provided there is no malicious intent. See this case here where the plaintiff lost on appeal and ended up having to pay all the legal costs for both parties.

I can only refer with any certainty to a 20-year-old building of about 130 units with a valuation (coincidentally) of $130m where the premiums are just shy of $150K. All of which adds up to $1150 per unit per $1m dollars of value. So you are in the ballpark as far as cost per unit goes.

Once you are on the tax merry go round, its very difficult, but not impossible to get off. Dont expect the strata manager or accountant to assist.
Perhaps the committee could instruct the strata manager to NOT file the tax return and leave it to the treasurer.

Maybe our insurers could provide levies insurance? There’s a business opportunity if ever I saw one. They cover death, travel, cars, homes, strata – why not unexpected levies?
