Imagine you have moved into your new home – a relatively new apartment – and everything seems fine.
Then it rains. Not just a light summer shower, but the Biblical rains we have been seeing over the past few months and years. And the water starts pouring off the balcony above, on to yours.
‘Could you clean the drains up there, please?’ you ask.
‘There are no drains,’ is the reply. “It was designed to overflow.’
This takes us into a whole new area of strata responsibility. What do you do when your neighbour’s flat has neither been designed nor built to adequate standards?
