The non-residents having seen our empty car parks ( close to public transport so not many residents have cars ) started to permanently park their cars in our car park. At first, only the opposite neighbours  ( they have their own garage but enjoy our car park more ) with 2 cars, now another 2 neighbours (also with their own garage) a little further away also started to park their cars their permanently  24h/d,  7 days /week. My visitor can’t park in my spot because it is parked by another resident whose spot is illegally occupied by non-resident. I contacted the strata manager ( just email, not a formal complaint – Melbourne, Victoria) to ask the owners corporation to install a chain fence or security fence but the EC has refused. What can I do ?

My last building I lived in had similar issues. After much pressure the Strata fitted spaces with bollards that could be raised while not in use to prevent non-resident parking.

It seems unless signage is displayed to say that illegal parking is prohibited there is little anyone can do about the situation. You could always find someone you know to use the space during the day if they require it.

Even having signage doesn’t mean you can remove the illegally parked vehicles. It’s a nightmare for people in this sort of situation.

Not to sure about the law in Vic but generally you cannot tow away (or clamp) a vehicle without the owners consent.

You can get around this by having a bylaw allowing you to tow or clamp but this would only apply to residents of the complex. This is because the residents have agreed to comply with the bylaws and so if the bylaws say you can tow the residents have given implied consent to have their vehicle towed.

This would not apply to non residents and so you are stuffed.

        Hi All,

I think I posted to a similar thread some time ago with this same reply…

I downloaded, printed and used JTs sticker from this website. Worked a treat!

Perhaps if it has not been deemed illegal in the meantime JT could post it again.

        Best of Luck
