I’m treasurer for a 15-unit NSW Strata Plan. A new owner has moved in and found magnesite under the wooden floor. She’s insisting that the Strata plan pays for its removal. Quotes over $20,000 have been obtained. Are we required to remove all the magnesite or just the areas that pose a risk? If there’s no evidence that the magnesite has swollen due to water penetration, therefore threatening to cause concrete spalling, does that sound magnesite need to be removed? I should add that when we’ve encountered this problem in another unit, we simply paid for the perished/broken magnesite to be removed and repaired the damaged concrete/reinforcement steel below.
What are our legal obligations in 2021?
