I know there are precedents now that make by-laws enforceable for not smoking on balconies if it causes smoke to enter other units, and in that case, the smokers have to smoke inside their unit. But what happens if this also leads to smoke entering other units?
The unit next door to mine is a short term rental, and sometimes the people in there smoke SO much that they may as well be smoking inside MY unit! if they smoke on the balcony, it comes in through my balcony. If they smoke inside, it comes in under their door, into the foyer, and into my unit.
Also in general, with short term rentals, if the landlord says no smoking inside, then that forces people to have to smoke on the balcony…which is against the by-laws.
How is any of this actually enforced??
