Quick one I hope. Can someone please point me to where, in the NSW Strata Titles Act, alterations to Common Property which change the nature of our 40 unit Sydney strata’s buildings and common garden areas might be covered?
The current Strata Committee have had a path put in, more of an aircraft runway actually, which has led to many residents now walking past at all hours on the previously quiet-garden-side of the building, past others’ living areas. Hard to explain but access to common stairs, halls and all units is supposed to be on the other, non-garden, outlook side.
Strata Committee agendas and minutes on a secluded notice board did herald this development but nobody expected the over-the-top, tasteless extravaganza which we now have.

“Changes to common property
(1) Procedure for authorising changes to common property An owners corporation or an owner of a lot in a strata scheme may add to the common property, alter the common property or erect a new structure on common property for the purpose of improving or enhancing the common property.
(2) Any such action may be taken by the owners corporation or owner only if a special resolution has first been passed by the owners corporation that specifically authorises the taking of the particular action proposed.”
