Advice on developing a strata by-law in NSW governing AI usage and the protection of confidential strata information including committee business documents and agreements. What are the risks? What policies should be in place regarding using AI for assessment? Are there any existing model by-laws to assist strata committees? Any other guidance in this evolving field.

As you say, it’s an evolving field. I would think that any by-law you create would be out of date within a year or two. What is your particular concern? You don’t want the minutes of your meetings, or your quotes and invoices, to be used to teach AI? You don’t want someone using AI to prepare a by-law or a Tribunal defence? In the latter case, just deal with the situation if and when it arises. If someone has used AI to prepare a document or an argument, you can edit and correct the document (or ask them to) at the time. If you don’t want your minutes or invoices to be used to teach AI, you might ask why not. What is so private?
AI might also be introduced into some service offerings, such as fire safety inspections or analysing plumbing leaks. Do you have an issue with this? If it’s an improved techology with improved performance, would you want to ban it? Or would your by-law encourage it, and if so why do you need a by-law?
Off the top of my head, I can’t think of other issues that might be of concern. Perhaps if can be more specific we can think more deeply about this.
Uberowner is right to ask what the potential or actual problem is. AI could be very helpful in your strata scheme. Imagine if you fed all the past five years’ committee minutes into AI and asked it to summarise the issues that have taken up most time and those that are still unresolved.
Your biggest issue is unlikely to be the theft of information – most of which is almost publicly available anyway – but people using AI to formulate arguments in favour of something they want (that the majority doesn’t) and thinking they are asking a machine that knows everything, rather than a computer program that aggregate information from different states to tell you what you want to hear.
