    I’m sure many strata schemes have discovered, well after the defects liability period, that building elements certified as compliant by the developer/builder DO NOT COMPLY….typically water-proof membranes, fire dampers in ducts, in-ground plumbing etc.

    As the developer/builder have long gone taking their profits with them, is it possible to sue the independent certifier engaged by them, especially if their is evidence that what was certified clear didn’t comply?
