At a recent EGM the Strata Manager was tasked with recording and tallying votes for a motion. He used a spreadsheet on his laptop which was not visible to the meeting attendees.

When he’d tallied the votes he announced that the motion had been narrowly passed. However, after the meeting I asked him to check that my votes were correctly recorded as I own 2 units, one of which I live in while renting out the other. He confirmed that he had made an error and had omitted my votes for the rental unit.

He confirmed that if he had correctly recorded and tallied the votes the motion would have failed. He stated both verbally (in the presence of the Strata Committee Secretary) and via an email to the EC members that he would send an email to all attendees within 2 days informing them that because of his error the motion was not passed.

Now the EC wishes to ignore the original vote and hold another vote. No email was sent to the attendees advising them of the error.

My question is this: can the result of the initial vote on the motion simply be ignored rather than corrected, and another vote be held on exactly the same motion? Aren’t the EC compelled to accept the actual results of the vote and recognise that the motion was incorrectly passed due to an error?
