There has been much discussion of “pre-1996” schemes in relation to the bylaw changes, but I have not found anyone stating an exact date to use for consideration in articles or forum posts etc.
The building I live in had it’s Strata Plan registered with LPI during 1996 and as such I have been intrigued as to the exact dates that “pre-1996” refers to.
Reading Strata Schemes Management Act 2015 (NSW) is says that pre-1996 means “… a strata scheme that was in existence before the commencement of the Strata Schemes Management Act 1996”
So I then read up on when did that Act commenced, and this is at the time of proclamation. Proclamation appears to be “Assented to 16.12.1996. Date of commencement, 1.7.1997” per the historical notes.
Therefore on my reading, any Strata Scheme registed on or before 30th June 1997 is a “pre-1996” scheme and need to be aware of the change to their standard bylaws http://www.flatchat.com.au/new-laws-old-schemes/
