In order to comply with BAL (Australian Standard AS 3959 – Construction standards in bushfire prone areas), our apartment block’s developer was responsible for installing fire-rated flyscreens in risk-affected units.

The developer hired a sub-contractor to install these about 3 months ago, and so far all they have done is drop the flyscreens off. No installation has been made to the extent of my knowledge.

I’ve tried calling the subcontractor repeatedly, and met with the receptionist/gatekeeper who roadblocks me with a “we’ll call you back”. The executive committee is seemingly useless, they apparently aren’t able to get in contact with the contractor as well. They’re looking into bringing in another third party to get them installed at the owners corporation’s expense.

Now I’m starting to think that this is bordering on ridiculous. Firstly, should this not be the developer’s responsibility to have these installed to comply by building standards?

Secondly, why is the executive committee so happy to have this installed at their expense? I would have thought that being owners, they would be fighting a bit harder to get the developer to cough up the dough for this?

What options do I have here. I feel that the exec committee aren’t doing all they can, and the developer/sub-contractor are just being too evasive to even get a hold of.

kenc – I imagine that the insect screens would have been incorporated in Council’s Development Consent by way of an item on the attached Fire Safety Schedule, in which case a call to that Council should see them get the Developer moving.
