For years there has been an issue with the drain on our terrace not clearing water. We have several years ago had water inundation to bedrooms and replaced carpets. Persistent requests to strata manager achieved a visit by a plumber who identified the problem as being mortar blocking the drain and the recommendation that it be cleared. Ongoing requests to the strata manager by us to have the drain cleared by a plumber and nothing has been implemented. The terrace has flooded, water flowed in to the bedrooms, the large Persian rug under the bed is sodden and the floor boards soaked. We requested urgent assistance of the strata manager with lifting the bed/carpet and the response was that it wasn’t a strata problem. We told them that we would be filing a claim because the problem had been identified and we had warned them of the likely repeat of the problem. We have no way of clearing the drain ourselves and the blocked drain is acknowledged as a strata issue. Can we claim our costs from strata (noting that we have asked for the problem to be resolved and predicted the flooding if it wasn’t addressed)?

Probably the simplest thing you could do is contact the building’s strata insurer directly and ask if they’ll cover the damage. Then get in touch with other owners and explain why they need to sack the strata manager before they cost you even more money.
