      How can we hold a Strata manager (and behind her a queen bee former Exec Committee Chair who still pulls the strings)  to keeping the commitment made at the last AGM that the mature (over 80 years old) trees accused on getting into the drains that were summarily executed, chopped down to ground level. The trees were according to the AGM report, were to be replaced –  follow up calls said the exec committee were getting  quotes for ‘landscaping’ – so far only a pile of gravel has been poured onto the front of the complex (the trees were at the side)  and nothing more. This summer El Nino will return, we’re told, last summer was hot enough. How can we keep this commitment top replace the trees with non-invasive root species -on track ? And – the plumber who deals with regular drain blockages has told me ” probably not the fault of the trees – your drains, like all the drains in this suburb- are old!”
      Don’t want to go to the Council if at all possible but will do so – young shrubs should be planted in winter and we’re almost at the end of winter.

        I would be applying for mediation with a view to taking a section 232 request for orders compelling the committee to follow the instructions of the OC.  I might even follow up with a request for interim orders to accelerate the process due to the time pressure of planting asap.

          Your committee volunteer to do, among other things, what owners collectively tell them. A vote passed at a AGM is their current, among other, riding instructions. It’s not their choice to pick and choose what they do and they have little leeway if the motion was specific enough. In Qld the official process can take a while unless it is something specific such as this (not getting on with it) – then you can pay a small bob more for expedited service to ensure it soon gets done.

            You’re right, of course.  But there are no Stratakops to come and beat them around the head when they delay the process with quotes and reports and lo and behold the weather has changed so we’ll have to wait until next year.
