This Strata is a 3 unit building next door to a high rise with <40> units rising from a platform underneath of which are two garage levels. Our building is 3 units only, the uppermost unit reaching only to their ground floor level. In the past year alone we have been assailed by rotten eggs, beer bottles and garbage hurled from apartments, poisons thrown onto our garden to inhibit the growth of plants.

During the past week, we have had to clear away fallen branches and garden debris dropped down onto our property as they readied their area for new railings. As a result of the water drilling to accommodate their new railing, we have had plants in our garden spattered with cement dust which no amount of rain has been able to wash away, not to mention pathways, decks, landings also spattered.

Yesterday their garage was washed down through an outlet some 20 metres above ground level spattering washing hung out on our lines. During the “wash-down” we endured yet again another deluge of water, this time containing cement residue, draining down through that illegal outlet into our property. We have a video of another deluge occurring some months ago.

These latest incidents just indicate the lack of awareness at best and complete disregard at worst for this strata. We have no intention of battling with next door as we are somewhat at a disadvantage (David /Goliath springs to mind).

Is there not some sort of legal requirement for buildings to inform neighbours of impending work and intention to prevent damage/inconvenience to neighbours?
