Hi all,
What’s the go with installing a security camera in a shared carport ? Previous history with my neighbour denting my car numerous times. Even though I park hard to the right on the carport wall and get out the passenger side to give her rather large car extra space. Left her paint behind even though she denied it. And of course we are no longer on speaking terms. I now have a new car (not by choice) and she has chipped the paintwork on the passenger side and attempted to repaint the damage. I’m absent 12 hrs a day and she is home full time. The car has been parked in the carport nearly 24/7 since delivery so no doubt about the culprit but of course I don’t have visual proof. Am I allowed to put a camera in with the angle solely on my car ?

LoisLane101 – In general you can’t point a security camera in a location that a reasonable person would expect to be afforded privacy. If you point the camera at your car port space ONLY and away from any windows etc then you should be OK.
You should also disable any audio capability. In NSW or the ACT, the recording of private conversations without consent is prohibited.
I think the threshold issue is installing a security camera on what I assume is common property. To do that, or install anything on common property, you would need to get the permission of the Owners Corporation.
Perhaps you should approach the Committee and raise concerns about the damage to your car, and take it from there?
As scotlandx has pointed out, carports may (or may not) be common property. Check the strata plan.
In general, carports are common property, unless they are within the cubic space of a lot and are referred to in the strata plan as belonging to a lot, or have been installed by an owner after registration of the strata plan.
Consider buying a dash cam that triggers recording on motion detection. Mount inside of the car pointing front and possibly a second pointing to side to catch all the action.
