      Hi Jimmy and brains trust

We’re about to enter into a large contract with a builder for remedial work on balconies constructed in 1975. The contract is on a Fair Trading template. The legal quote for review of contract start at $2,500.

      Questions:

      a) Does the quote look reasonable?

      b) Should we be using alternate base template – is the FT one too ambiguous? others e.g. HIA or Master Builders?

      c) Should we be exploring making a claim against our building insurance for some of the costs of the remedial work? Is it maintenance or other category?

      So much to decide!

      cheers

        Hi Jinx,

I was involved in a similar building contract.

We had legal advice that the FT contracts are not tight enough and in the builders favour.

Cost $3300 legal fees to rewrite a new contract. Fortunately, we have had no dispute and the work is finished.

PLEASE ... If your property is not in NSW, mention its location (state). Don't identify companies or individuals by name. Don't mention or promote your company or services. Keep acronyms and initials to a minimum. Please, don’t use “quote” unless there is a specific point to which you wish to refer, then highlight (define) that specific passage before you click on "quote". Otherwise just use reply. THANKS.
