    We’ve recently decided to upgrade the lift in our building in order to bring it up to code and ever increasing costs due to the age of the lift and availability of parts.

    The main question that has been coming up quite frequently over the last month is access to the building and how this effects renting tenants. With the lift out of order, the only access to the apartments (with the exception of ground floor apartments) is via the fire escapes. As I understand, fire escapes are not supposed to be used for regular access to an apartment – There are no safety rails in the fire stairs and should any accidents occur through their use during the period, who would be liable? The other matter is that our fire escapes can be opened from the outside using the common area key which is issued to all residents.

    I would like to get some commentary on past experiences and whether or not throughout the lift upgrade period (14-16 weeks), reduced or rent free periods apply, and if there is anything in the residential tenancy agreement?

      menkariTHIS previous discussion on Flat-Chat might assist, as may THIS fact sheet produced by the Eastern Area Tenants’ Service, but surely the lift maintenance company has in the past come across similar situations to the one faced by your Owners Corporation and could therefore offer some advice (?).
