My friend who is fighting a lone battle against rogue parking, not onl in the visitors spots but also all along the driveway, was caught taking photos of these rogue parkers. The owner of the photographed car said that it was illegal to take photos. My friend was taking photos after discussions with fair trade who said that evidence, such as photos of the parked cars, would help the cause.
I have also taken photos here in my complex of rogue parkers. No people just the cars and the rego plates. The residents know I have such a file of evidence and in my case this has worked in my favour as they have made themselves scarce and are parking in their own spaces or on the street! So can anyone tell me so I can also tell my friend if taking candid photos is infact illegal?
Further on my friends situation. There has now been an accident where a car parked outside a garage in the driveway has been hit by a car trying to get through the obstacle course that this complex’s driveway has become. The resident of the car that was hit whilst parked outside his garage was very angry! I mean fancy someone actually wanting to drive down the driveway! And as his car is parked there everyday, surely the driver should have known that this leaves little space to pass so should have parked on the road rather than attempt to get to his own garage. The nerve!

The short answer to that is no, it is not illegal to take photos of cars. I won’t go into detail but why would it be, is the photographer invading the car’s privacy? Bear in mind that the property is not a public space, but the person taking the photo is entitled to be there. The issue centres more around the use of the photo.
The easiest way to deal with someone like that is to ask them for the specific legislation to which they are referring, i.e. what legislation provides that taking photos of a car is illegal, and also the section of that legislation. If they want, they can also ask if it is a civil or criminal offence.
Agree with Scotty on this one. I’m amazed at the number of people who say “what you are doing is illegal …” when they have no idea whether it is or not and think we are all going to run away screaming.
But then Strata is full of know-alls and Bush Lawyers … I know cos I are one.

Have often had to photograph cars parking in my space illegally as evidence. Never had an issue as such with anyone, often have left these photos under the wiper of cars who are repeat offenders
There is nothing to stop you from taking photos of common property. You can’t help it if an illegally parked car gets in the way of your photo.
(yes, I think this is a variation of Jimmy’s old comments regarding placing notices and stickers on cars)
