Our SC recently had a meeting with only 4 of the 9 members in attendance.

The Chairman held two proxies. We feel that these proxies may not be valid as they were probably signed before the Agenda was set and distributed.

We have requested a copy of the Agenda and information about when it was circulated from both the Strata Manager and the Chairman. This information has not been sent to us and nor has our email request been replied to.

The committee members present agreed to engage a lawyer to respond to a formal complaint we have made about the committee and in particular one member of the committee. Our formal complaint was made via a lawyer.

So, are the proxies valid if there had been no discussion of engaging a lawyer when they were signed?

If the proxies are not valid, are the four members of the committee who agreed to engage a lawyer, liable for payment for the lawyer?

If the engagement of the lawyer is valid , which member of the SC should be nominated to deal with the lawyer?

PLEASE ... If your property is not in NSW, mention its location (state). Don't identify companies or individuals by name. Don't mention or promote your company or services. Keep acronyms and initials to a minimum. Please, don’t use “quote” unless there is a specific point to which you wish to refer, then highlight (define) that specific passage before you click on "quote". Otherwise just use reply. THANKS.
