I have recently purchased a unit and found the airconditioner does not work. This is a system that has a cooling tower on the roof, water pipes extending to each unit in the block and an airconditioning unit for each unit located between the concrete slab and a suspended ceiling within the walls of the unit. The A/C system and suspended ceiling were part of the original building, built in 1983.
The fault in the A/c relates to an electric motor that is shorting out and tripping the 415 volt circuit breaker.
My interpretation of the lot definition is that the lot is bounded by the lower surface of the ceiling, the walls and the slab foor. Thus would the space in which the A/C unit is placed be structural cubic space – common property. In the same space between the concrete slab and suspended ceiling there are copper drainage pipes for the showers, vanities, laundry tub, etc
Another owner believes the lot is bounded by the slab above, the walls and the slab below.
Can you shed any light on this?

The ‘memorandum of understanding’, devise by the wise men and women of strata last year, says air conditioning that serves more than one lot is the responsibility of the OC and air conditioning that serves one lot, whether it’s inside or outside the lot, is the responsibility of the owner whose lot it serves. Now, this is not strata law but it is an indication of how the CTTT would think if the case came before them.
