We are living in a block of 4 units with 2 upstairs. One owner requested that the heat in the atrium is managed as it results in main doors needing to be kept open as a means of controlling the heat in the summer months. This impacts on security. The heat goes up to over 50 degrees in summer and does impact on the units. This is not a repair and maintenance issue but should the matter be addressed? There are 2 sets of 4 units.

It’s a common property issue regardless of the label you put on it. Health and safety, perhaps?
The committee should investigate economical and efficient ways of reducing the heat. Natural flow of air that doesn’t require leaving the building wide open would seem to be a potential answer. In other words, vents!
Put a motion to the committee and if they are reluctant to spend money, wave section 232 at them.

It’s a defect that could not reasonably have been anticipated before purchase unless there had been a complaint before.
Apply for mediation at Fair Trading then, if the problem is not resolved, apply to NCAT for orders under section 232(e) on the grounds that the strata committee has failed to “exercise, a function conferred or imposed by or under this Act or the by-laws of a strata scheme.”
