      Due to a error by our tenant we had water ingress into the common area from our private lot (apartment).

      The subsequent bill to dry the carpets etc in the common area is nearly $5K.

      As it was our fault; am I right in believing that we cannot claim either through our apartment contents insurance policy nor the owner corporation?

      All of the guidance on line leads me to understand we just have to pay it and try to recover some costs from the tenant.

        I think this would be worth an initial discussion with the contents insurer. But read both insurance policies and the answer may become clear. For $5K it may be worth just paying. Any claim is likely to result in a higher premium.

          You have not specified what the ‘error by your tenant’ was? I assume they left a tap running and flooded the place, or something similar. Most sensible thing for you to do is read your PDC of your insurance policy to see if it will cover ‘tenant error’, and submit a claim anyway since you have nothing to lose. If they decline your claim then you have your answer.

            So tenants are “probably” adept debt dodgers?  Seems a bit unfair.
