Our complex was built in 2015. I would like to understand whether the waterproofing is actually a common property.
In one of the townhouse whenever they use the shower in the 2nd floor, there is a leak and goes to the 1st floor. These are just under one townhouse. Will this be considered common property under villa style strata?
I am confused since I have the view that: For a leak from a shower on the second floor to the first floor that is entirely internal to one owner’s townhouse (villa-style strata lot): Is considered the owner’s responsibility, as it occurs within the airspace and boundaries of their private lot. They consulted a plumber and the plumber said it is common property. I don’t think the plumber has the final authority for this. I am open to be corrected but I need to have a clear direction or writing whether this is actually a common property. I did research the Strata Plan and it doesn’t specify it anywhere there.
