Carpets on my floor are now soaked in water, and damaged. There trying with a cleaning repair company, but problem is not enough air, or sun, as fire safety doors shut out alot of natural sunlight, so bacteria and mould will develop.

So I want to make a claim to the (OC) to pay and change the carpet on my floor. Would they make a claim, via there public liability insurance?

If they refuse and say no, do I go to fair trading first, and mediate? If that fails the Adjucator?

Strata building insurance doesn’t cover carpets within the lot, these should be on your contents policy.

The only time that the Strata would be liable was if the damage to the carpets was due to a failure of drainage infrastructure or lack of maintenance of the said infrastructure.

Whether the damage was due to extreme weather (contents policy) or Strata negligence (Strata) would depend on who pays.

This carpet damage is on common-property, not in the lot. On the level foyer, I made a mistake I should of been more clear in my top-post, it was common property-carpet in the foyer.

So we have windows in your apartment that are leaking and carpets in common property that are soaked?

Not strictly true.  The home & contents insurer could say that the failure of common property (the windows) caused the damage so the strata insurance should pay.  This would apply if there were windows that didn’t leak.

Yes I didn’t explain it properly before. Windows leaking in my apartment, and Carpet soaking on our Level Foyer next to the lifts, correct.
